The Unified Development Control and Promotion Regulations (UDCPR) is a comprehensive set of provisions governing urban planning and building construction in Maharashtra State. It was sanctioned by the State Government and published on December 2, 2020, under Section 37(1AA)(c) and Section 20(4) of the Maharashtra Regional & Town Planning Act, 1966 (MRTP Act). The UDCPR was created to solve the problem of disparate and non-uniform Development Control Rules (DCRs) that previously existed across various Planning Authorities in the state. By consolidating these laws, the UDCPR aims to ensure orderly and sustainable development, improve the ease of doing business, and increase the stock of affordable housing.
The mechanism of the UDCPR involves detailed regulations on land use classification, procedures for development permission, and building requirements. Key provisions include defining the permissible Floor Space Index (FSI), which is the quotient of the built-up area to the plot area, with a base FSI of 1.10 proposed for roads less than nine meters wide. The regulations also mandate that 10% of any layout must be earmarked for recreational purposes. The UDCPR connects directly to the MRTP Act, 1966, and includes specific regulations for Slum Rehabilitation Schemes (Regulation No. 14.7) under the Maharashtra Slum Areas (Improvement, Clearance And Redevelopment) Act, 1971. The UDCPR replaced the earlier fragmented DCRs across most of Maharashtra, but it is explicitly not applicable to the Municipal Corporation of Greater Mumbai (MCGM) and a few other specific authorities. The regulations have been subject to updates, such as those made up to January 30, 2023.
